Payment Using Credit Card

Fommy.co.uk accepts the following credit cards - VISA, Delta, MasterCard, Maestro, Solo and Switch. In addition, there is no charge for debit card usage on any website owned by Moftware. All credit and debit cards are verified via Protx payment gateway prior to processing order for shipment.

Payment through PayPal
PayPal is an independent agency offering an alternative payment option, for safe online transactions. For online purchases, the customer will be redirected to the PayPal website, where she/he can use this ID. The PayPal site ensures a secure transaction. After the PayPal transaction is complete, the customer will then receive an invoice via e-mail, providing transaction details.

Moftware takes the utmost care in keeping all customer information confidential. All details disclosed in the order process are used solely for the purpose of the specific transaction(s).

VAT

All prices shown on our website are inclusive of VAT, and we have differentiated both the inclusive and exclusive VAT charges on all the products and on Shipping/Delivery Charges.

VAT is charged on all goods sold, at the standard UK rate of is 20%. All products prices and on Shipping/Delivery Charges will be as per new VAT from 4th January, 2011.

Shipping/Delivery

With Moftware you have the opportunity of receiving your merchandise via the best of shipping service provider in UK – RoyalMail. You can track your order from the RoyalMail website www.royalmail.com.

Shipping Options


Domestic (inclusive of England, Northern Ireland, Scotland and Wales) Shipping

1) UK Standard Post Delivery - 3-5 working Days - £2.49 (exc. VAT) for 1 item and £0.84 (exc. VAT) for each additional item.
This shipment mode is available only for Orders below £5. No Tracking Number will be issued and will be shipped via normal delivery. Usually the goods are delivered by 3-5 working days.

2) UK Recorded Post Delivery 2-5 working Days - £4.15 (exc. VAT) for 1-3 items and £0.84 for each additional item.
A signature will be required on receipt of goods. If a delivery is unsuccessful, then a card is left to arrange collection or redelivery. Usually the goods are delivered by 2-5 working days.

1) EU AIRMAIL SMALL PACKET Post - £5.83 (exc. VAT) for 1-3 items and £0.84 for each additional item.
This shipment mode is available only for Orders below £5 Delivery times can vary within the EU, from 3-7 working days, and proof of postage is taken at the time of despatch from Royal Mail post office.

2) EU Special Post - £7.49 (exc. VAT) for 1-3 items and £0.84 for each additional item.
A signature will be required on receipt of goods. Delivery times can vary within the EU, from 3-7 working days.The service used is International Signed for service by Royal Mail.

3) EU Courier Post - £24.99 (exc. VAT) for 1-3 items and £0.84 for each additional item.
A signature will be required on receipt of goods. Delivery times can vary within the EU, from 2-5 working days.

Rest of the World Shipping

1) Special Post - £10 for 1-3 items and £0.99 for each additional item.
A signature will be required on receipt of goods. Delivery times can vary within the EU, from 3-10 working days.The service used is International Signed for service or AIRSURE (if offerd for the country) by Royal Mail.

2) Courier Post - £34.99 for 1-3 items and £2.00 for each additional item.
A signature will be required on receipt of goods. Delivery times can vary within the EU, from 2-5 working days.

Incorrect/Incomplete Addresses
Moftware is not responsible for the cost shipments returned back from shipping company due to inability to deliver when address provided is incorrect or incomplete. Therefore at the time of placing the order please provide, in addition to the correct address, any additional pertinent details such as building name/number and apartment/suite/unit numbers. Shipping fees will be charged again if customer requests order to be reshipped. This policy also applies to any returns/refunds due to the same situation.


Software Orders

All intangible or downloadable products/software(s) are subject to the following conditions:

Software orders are dispatched via e-mail containing a download link and the key for the software. Since software orders are fulfilled via e-delivery, please make sure that you provide us with a correct and valid e-mail address. Any dispute arising due to incorrect e-mail address shall not be liability of Moftware. Please note software orders are non-refundable. In case of technical failures (Mail servers failures, Server Maintenance, etc…) there may be delays in fulfilling orders. Under such circumstances, Moftware cannot be held responsible or implicated in any respect. Under no circumstances will returns for software be processed once the installation key has been sent to the customer.

Product Returns or Order Cancellation

Part or Missing items, Damaged good, Late or Lost Delivery
While all care is taken to ensure appropriate stock levels, all products and services are subject to availability and may be withdrawn at anytime without prior notice. If we do not supply the goods for any reason you will be notified and if we have taken payment, will be refunded in full.

We may part dispatch your order, please note in the delivery note and it is your responsibility to check your consignment and if any incorrect goods are supplied you must notify us within 24 hours of delivery. After this period mistakes cannot be rectified.

In the unlikely event your order is damaged in transit please contact customer care executive within 24 hours of receipt. Please retain the original packaging for returning your order.We will ask you to send us the damaged packaging and promptly replace goods after evaluation of the damage.

If we deliver to a business or home address at your request, you are agreeing that anyone situated at such address has your written authority to accept goods on your behalf. We will accept no responsibility for goods once they have been delivered to and signed for at the requested address.

We are not responsible for lateness of delivery resulting from the following scenarios: Payment Processing issues, adverse weather conditions, Inaccurate address / email information and industrial action by the courier companies.

If you have not received your order within 7 working days of dispatch email, you must immediately advise our customer care executive of the delay/loss. Royal mail does not consider any goods lost or delayed until after 15 days from the date of posting.

In the event of a decision made to send you a replacement order, you will need to complete a “declaration of non-delivery” of the initial order. The declaration form will be sent to the email address supplied with the initial order, and on receipt; requires completion in full and return by fax or post to the customer services.

We will send replacement order once we have received the signed non-delivery declaration form. If however in exceptional circumstances* we have shipped you a replacement order and we have not received the declaration of non-delivery, then you will become liable for the cost of the initial goods & postage, which will then be charged to the method of payment for your order. Duplicate forms can be requested from our customer care executive. *Based upon the circumstances, and Fommy.co.uk’s sole discretion which is non-negotiable.

YOUR RIGHT TO CANCEL
We do not operate ‘try before you buy’ policy. Postage and packaging charges are non-refundable. Under the Consumer Protection (Distance Selling) Regulations 2000, you have the right to cancel the contract for the purchase of your order within seven days of delivery (starting the day after the receipt of the goods).

CANCELLATION BEFORE THE ORDER IS SHIPPED
It is only possible to cancel your order if it has not reached the delivery process. Our customer service executive will be able to assist you to cancel your order. Please contact Customer Service (chat link) and provide your order number. We will charge a small processing fee of £2 or 5% of the order total, whichever is higher if cancelled at this stage as handling fee.

CANCELLATION AFTER YOUR ORDER HAS BEEN SHIPPED OR YOU HAVE RECEIVED THE ORDER

You are responsible for returning the items in a re-saleable condition. The item must not have been used, must be complete with all components and the packaging must be not be damaged. Note that if these conditions are not met we may not accept returned goods at your cost. Refunds will be for goods only and will not include any carriage costs paid to us. We recommend using a posting method that provides proof of delivery and can compensate for lost or damaged goods for higher value items. Please ensure that all returns are securely wrapped and packaged. We cannot be held responsible for any units that have been damaged in transit.

RETURNS POLICY
In addition to your statutory rights, if you wish to return goods outside of the 7 day cancellation period, we operate a 28 day faulty returns period.

We do not operate a try before buy policy. Postage and packing costs are non-refundable. All of the products on sale have met our high quality-control standards. However, any goods found to be defective within 28 days will be replaced. Goods found to be tampered with by the customer will not be replaced, but will be returned at the customer's expense. If you wish to return goods which are not faulty, we will accept the return providing the goods are in a good clean condition in the original packaging and having not been used. These goods can be exchanged for other products, subject to the difference in costs being incurred. Items returned for a refund, when the goods are not faulty will be charged a handling fee of 15% or £5 whichever is higher.

Replacement or alternative items will be processed as promptly as possible, but please be aware that it may take up to 5 working days to issue the item. If an item is out of stock, it will then become a priority back order to be shipped once stock is available.

Refunds by credit card are made to the same credit card that was used for the original purchase. Please be aware that it may take up to 30 days for your card to be refunded. The above conditions are in addition to your statutory rights, which are not affected.

Refunds will be for goods only and will not include any carriage costs paid to us. Please ensure that all returns are securely wrapped and packaged. Special Terms
Bluetooth products are accepted for a refund only if they have never been opened and if you are returning within 30 days from the invoice date. Without exception, there is no refund/exchange available for open box Bluetooth products. This disclaimer also includes all carkits. In addition, we cannot recommend procedures and/or installers for carkits nor can we accept returns for any merchandise that cannot be installed after the package has been opened. It is the responsibility of the customer to work out installation for the carkits purchased through our websites.

In the event that your product may be defective, please contact the manufacturer directly from this link www.fommy.co.uk/manufacturer-support.htm. A product must be diagnosed "defective" by a member of the Technical Support Staff at the manufacturer. Once it has been diagnosed, please ask for a case number and contact our customer service department for a RMA#.

Return procedure

b. Print the Return Slip, which you have generated.
c. Now, Contact Customer Service Representative at care@fommy.co.uk or Live chat.

e. Ensure you have enclosed the original Return Slip inside the box, along with the products being returned and attach one copy on top of the package/box.
f. Returns not adhering to our terms shall be sent back to the customer at his expense.

You will need your order number and email id. Once the page is filled print a copy, ring up customer care to obtain the authorized RMA number. Write this RMA number, sign the form and enclose in the box along with the original packing slip sent with the order to you. Remember to clearly mention the RMA on the outer packaging of the package. Our return warehouse does not have facility to accept goods without RMA hence if the RMA is not written clearly on the packages chances are that the package will be lost. Please note our return warehouse is not geared to accept and handle packages without RMA clearly written on the package.

The goods must be returned at your cost and in original condition within 7 days of receipt of Authorization Number. Please note that goods returned without their original packaging or incomplete or in any way not in full resalable condition will not be refunded and will be returned to you at your cost.

One of our return team will inspect your goods prior to replacement or authorize refund and we reserve the right to deem the goods as second-hand or open box return, and deduct 15% or £5 whichever is higher should any items not be returned in their entirety or in an AS NEW condition. All software packages and drivers must be returned unopened and unregistered. You will be refunded the value of your order less postage within 30 days of us receiving your goods. Please package any returned items carefully and return them, for your own protection, via a recorded and insured method of carriage such as Royal Mail Special or Recorded Delivery. The carriage costs and insurance are the responsibility of the customer unless the goods were delivered to you in error.

Manufacturers Warranty
Outside of the 28 day faulty return period, returned items can not be accepted, unless covered by manufacturer’s warranty. Items returned to us will be forwarded to the manufacturer for repair or replacement.

CONTRACT AND PRICING ERRORS / TECHNICAL ACCURACY AND COMPATIBILITY
We will treat each order for goods as an offer by you to purchase the goods subject to these Conditions. You are deemed to accept the Conditions when you place an order for goods with us. Our contract with you only begins when we have validated payment and have despatched the goods. Any communication which you receive from us prior to despatch is not to be deemed as acceptance of your order. In the event of any pricing error occurring within a written or verbal quotation, or contained within any fax or e-mail correspondence however received, all these orders shall be deemed void. In these circumstances, you receive a full refund. We are entitled to make adjustments to the price to take account of any increase in our supplier's prices. If due to an error or omission the price published for the goods on our website is wrong we have the right to terminate an order. Should such an error occur we would inform you of the revised price and give you an opportunity to cancel the order. You are advised to obtain the full product specs from the manufacturer’s website.

Price and payment
All prices are inclusive at the current rates and are correct at the time of entering the information onto the system. We reserve the right, however, to change prices at any time without notice to you.
Payment can be made by any major credit or debit card. Payment will be debited and cleared from your account before the dispatch of your good or provision of the service to you.

You confirm that the credit or debit card that is being used is yours.

Orders
All orders are subject to acceptance and availability. If the goods ordered are not available, you will be notified by e-mail (or by other means if no e-mail address has been provided) and you will have the option either to wait until the item is available from stock or to cancel your order. Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time. Each good purchased or sold is subject to additional specific terms and conditions related to that good including, without limitation, terms and conditions concerning estimated delivery times and any warranties. Please ensure that you read such additional terms.

12-month warranty where provided by the manufacturer

Outside of the 28 days faulty return period, returned items can not be accepted, unless covered by manufacturer's warranty. Items returned to us will be forwarded to the manufacturer for repair or replacement.

The customer must notify our customer service department within the warranty period that the equipment is faulty or defective and describe the problem(s) they are experiencing.
The customer must return or arrange with us to collect the equipment within the warranty period.

The equipment must be returned properly addressed with RMA number and provided with adequate protective packaging.

The equipment must be returned along with the dispatch note as proof of purchase. If the customer does not still have the dispatch note, we must be satisfied from other evidence that the equipment was purchased by them from us and that the date of purchase was within 12 months of the claim under this warranty.

The customer will be responsible for the return of the equipment until it arrives back with us. If we have arranged to collect the item, the customer is responsible for it until it is in the possession of our appointed courier.

The customer is responsible for the cost of returning equipment to us (including our reasonable costs of collection where we collect the equipment, which must be paid in full before your equipment or any replacement equipment will be returned or delivered to you), unless otherwise agreed by our customer service department. We shall be responsible for the cost of returning or delivering repaired / replacement equipment to the customer.

This warranty only applies in respect of faults or defects that are due to faulty design, manufacture or workmanship. No repair or replacement of equipment will be provided if the equipment has been willfully damaged, misused, neglected, overloaded, modified, adapted or repaired (except as authorized by Moftware).

Equipment returned to us under this warranty may at our discretion be either repaired or replaced with equipment of a similar specification and condition. Please note that we reserve the right to provide replacements that are reconditioned rather than new.

No repair or replacement of equipment will be provided unless and until all sums due to us in respect of the equipment have been paid in full by the due date.

The warranty may not extend to consumable items including amongst other things cases, cables, facias, skins, batteries, fuses, case clips and stands, similar etc.

Upon return of repaired equipment or delivery of replacement equipment the customer may be required to sign as evidence of receipt.

This warranty is offered as an extra benefit and does not affect consumers' statutory.

Intellectual Property
The content of the Website is protected by copyright, trade marks, database and other intellectual property rights and you acknowledge that the material and content supplied as part of the Website shall remain with us or our licensors.

WEEE Regulations:

The Waste Electrical and Electronic Equipment (WEEE) Directive is now UK law. The legislation aims to make producers pay for the collection, treatment and recovery of waste electrical equipment. The regulations also mean that suppliers of equipment like high street shops and internet retailers must allow consumers to return their waste equipment.

The amount of WEEE we throw away is increasing by around 5% each year, making it the fastest growing waste stream in UK.

  • Much of the UK's WEEE ends up in landfill, where the lead and other toxins it contains can cause soil and water contamination. This can have a harmful effect on natural habitat, wildlife and also human health.
  • Many electrical items that we throw away can be repaired or recycled. Recycling items helps to save our natural finite resources and also reduces the environmental and health risks associated with sending electrical goods to landfill.
Distributors of new Electric and Electronic Equipment (EEE) have a part to play in reducing the amount of WEEE going into landfill sites.

FOMMY is obliged under these regulations to offer our customers free take-back of their WEEE on a like-for-like basis when they buy a new Electrical or Electronic product from us.

For example, if a customer bought a new charger from us we would accept their old charger and prevent it going into a landfill site by disposing of it safely. Customers must return their WEEE item to us within 28 days of purchasing their new item.

Under the WEEE Regulations, all new electrical goods should now be marked with the crossed-out wheeled bin symbol shown below:


Goods are marked with this symbol to show that they were produced after 13th August 2005, and should be disposed of separately from normal household waste so that they can be recycled.

Information on Battery Recycling with Fommy.co.uk


Fommy.co.uk is working with Defra (Department for Environment, Food & Rural Affairs) to take back and recycle used batteries free of charge for recycling for customers within the UK.

By recycling your used batteries via dedicated battery collection points you are contributing to protecting our environment and the earth's natural resources.

Batteries are made from important resources and chemicals, including lead, cadmium, zinc, lithium and mercury. If batteries are disposed of as normal municipal household waste, they will be taken to a landfill site and those resources will be lost and will contribute to the pollution of the environment. Recycling is one way you can help the environment and you should dispose of used batteries separately from other waste, using the collection and recycling schemes available.

Your role in contributing to the recycling of waste batteries and in preventing pollution of the environment is essential. Each used battery that you place in a recycling box will be taken apart and many of the materials will be recovered and used to make new batteries or something else.

All batteries are labeled with the crossed-out wheeled bin below, to indicate that they should not be disposed of as normal waste, but in specific recycling centers.





Batteries containing hazardous substances such as mercury (Hg), cadmium (Cd) or lead (Pb) are marked with their chemical symbol as well.


How UK Customers Can Recycle Batteries with Defra and Fommy.co.uk

Under the Waste Battery Regulations, www.fommy.co.uk are now offering a take back cheme for all portable waste batteries. You can arrange to give back the used batteries in person at our office in Wythenshawe (please do not post). Alternatively, you can find your local waste portable battery recycling facility at www.recyclenow.co.uk Most supermarkets and shops that sell batteries will have collection bins for used batteries, and some town halls, libraries or schools may also set up collection points. End-users may find stores in their local area more accessible.
